Welcome to XFER, a secure file transfer platform accessible at xfer.africa (the “Service”), operated by XFER Technologies (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our Service. By using XFER, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By using XFER, you confirm that you are at least 18 years old and legally able to enter into binding agreements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Use of the Service
2.1 Account Registration
Certain features may require you to create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials.
2.2 File Uploads and Sharing
XFER allows users to upload, share, and access digital files. You are solely responsible for any files you upload or distribute. You agree not to upload any content that:
Violates any laws or regulations;
Infringes upon intellectual property or privacy rights;
Is harmful, abusive, defamatory, obscene, or otherwise objectionable.
2.3 Prohibited Use
You may not use XFER to:
Distribute viruses, malware, or other malicious software;
Attempt to gain unauthorized access to systems or data;
Impersonate others or misrepresent your affiliation;
Upload or share content that promotes illegal activity.
3. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using XFER, you consent to these practices.
4. Intellectual Property
All XFER branding, design, software, and related materials are the property of XFER Technologies or its licensors. You may not reproduce, distribute, or modify any part of the Service without our prior written permission.
5. User Files
Files uploaded to XFER are encrypted and stored temporarily. We do not claim ownership over your files. However, by using the Service, you grant us permission to store, process, and deliver your files to intended recipients.
Uploaded files are automatically deleted after a limited period, as defined in our file retention policy.
6. Termination
We may suspend or terminate your access to XFER at any time, with or without notice, for behavior that violates these Terms or for other reasons at our discretion. Upon termination, your files and account data may be deleted.
7. Disclaimers and Limitation of Liability
7.1 No Warranty
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted access or error-free operation.
7.2 Limitation of Liability
To the maximum extent permitted by law, XFER Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or reputation, arising out of your use of the Service.
8. Governing Law
These Terms are governed by and interpreted in accordance with the laws of South Africa. You agree to submit to the exclusive jurisdiction of the courts of South Africa for any disputes arising from or related to these Terms.
9. Changes to These Terms
We may update these Terms periodically. Changes will be posted on this page with an updated effective date. It is your responsibility to review them regularly. Continued use of the Service constitutes acceptance of the updated Terms.
